Pocso का फुलफार्म (Fullform of Pocso)- पॉक्सो (POCSO) का पूरा नाम Protection of Children from Sexual Offences Act है, जिसे संक्षेप में 'पॉक्सो कहते हैं। यह एक्ट बच्चों के प्रति यौन उत्पीड़न और यौन शोषण और पोर्नोग्राफी जैसे जघन्य अपराधों को रोकने के लिए, महिला और बाल विकास मंत्रालय द्वारा बनाया गया है।The full name of POCSO is Protection of Children from Sexual Offences Act, abbreviated as 'Posco'. The Act has been enacted by the Ministry of Women and Child Development, to prevent sexual harassment towards children and heinous crimes like sexual exploitation and pornography.

POCSO Act और शिक्षक की भूमिका
प्रवेशन लैंगिक हमला (Penetration sexual assault)-
अगर कोई व्यक्ति किसी बच्चे के शरीर के किसी भी प्राइवेट पार्ट (अंग) में अपना जननांग या शरीर का कोई अंग जैसे- अंगुली आदि या अन्य कोई बाह्य वस्तु डालता है या बच्चे से स्वयं के अंगों में डालने को बाध्य करता है तो उसे 'प्रवेशन लैंगिक हमला' माना गया है।
If a person inserts his genitalia or any part of the body such as finger etc. or any other foreign body in any private part (organ) of a child's body, or obliges the child to put it in its own parts, then it is 'Penetration Sexual Assault' is considered.
दंड का प्रावधान (Provision of Infliction)-
नए अध्यादेश के अनुसार 12 वर्ष से कम उम्र के बच्चों के साथ रेप करने वालों को मौत की सजा, 20 वर्ष की सजा, आजीवन कारावास एवं जुर्माना की सजा दी जाएगी।
According to the new ordinance, rapists with children below 12 years of age will be given death sentence, 20 years of imprisonment, life imprisonment and fine.
वही 16 वर्ष से कम उम्र की लड़की से रेप करने वालों को दी जाने वाली कम से कम सजा 20 वर्ष की होगी।
The same punishment given to those who rape a girl below 16 years of age will be 20 years.
12 वर्ष से कम उम्र के बच्चों के साथ गैंगरेप के दोषियों को भी मौत की सजा, आजीवन कारावास एवं आर्थिक दंड की सजा दी जाएगी।
Gang rape convicts with children below 12 years of age will also be given death sentence, life imprisonment and financial punishment.
गुरुत्तर प्रवेशन लैंगिक हमला (Aggravated penetrative sexual assault)-
किसी संरक्षक (जिस पर बच्चा विश्वास करता हो), पुलिसकर्मी, शिक्षक या शिक्षिका, हॉस्पिटल स्टाफ, हॉस्टल अधीक्षक या अधिक्षिका या अन्य कोई संस्थान या व्यक्ति जिसकी देखरेख में बच्चा हो या जिस पर बच्चे को भरोसा हो, यदि वह 'प्रवेशन लैंगिक हमला' करता है तो उसे इस श्रेणी का अपराध माना गया है।
Any guardian (on whom the child trusts), policeman, teacher, hospital staff, hostel superintendent, officer or any other institution or person supervised by the child or who the child trusts, if he or she is 'penetrating sexual assault' If it does, it is considered a crime of this category.
दंड का प्रावधान (Provision of Infliction)-
नए अध्यादेश के अनुसार- 12 वर्ष से कम उम्र के बच्चों के साथ रेप करने वालों को मौत की सजा, 20 वर्ष की सजा, आजीवन कारावास एवं जुर्माने की सजा दी जाएगी।

लैंगिक हमला (Sexual assault)-
अगर कोई व्यक्ति किसी बच्चे के गोपनीय अंग को छूता है या बच्चे को अपने प्राइवेट पार्ट छूने के लिए बाध्य करता है तो वह अपराध लैंगिक हमला की श्रेणी में आता है।
If a person touches the private part or confidential part of a child or forces the child to touch his private part, the offense falls under the category of sexual assault.
दंड का प्रावधान (Provision of Infliction)-
3 से 5 वर्ष की कारावास की सजा एवं जुर्माना।
3 to 5 years imprisonment and fine.
गुरुत्तर लैंगिक हमला (Aggravated sexual assault)-
कोई पुलिसकर्मी, शिक्षक, हॉस्पिटल स्टाफ या फिर कोई ऐसा व्यक्ति जिसकी देखरेख में बच्चा हो या जिस पर बच्चे को भरोसा हो, अगर वह लैंगिक हमला करता है तो इस श्रेणी में आता है।
A policeman, teacher, hospital staff or any person who has a child under his supervision or on whom the child trusts, falls into this category if he commits sexual assault.
दंड का प्रावधान
(Provision of Infliction)-
5 साल से लेकर 10 साल तक की सजा और जुर्माना दोनों हो सकता है।
The punishment can range from 5 years to 10 years and both.
लैंगिक उत्पीड़न (Sexual Harassment)-
अगर कोई व्यक्ति गलत नियत से बच्चे के सामने अश्लील हरकतें करता है या बच्चे को करने के लिए बाध्य करता है, जैसे गंदे शब्द बोलना, अश्लील आवाज निकालना, अश्लील हावभाव या शरीर के कोई अंग का या वस्तु का प्रदर्शन करना, सीधे इलेक्ट्रॉनिक माध्यम, डिजिटल माध्यम, किताबें आदि से अश्लीलता दिखाना इस श्रेणी का अपराध होता है।
If a person mistakenly commits indecent acts in front of the child or forces the child to commit, such as speaking dirty words, making vulgar sounds, obscene gestures or display of any body part or object, directly by electronic means, Showing pornography through digital medium, books etc. is a crime in this category.
दंड का प्रावधान
(Provision of Infliction)-
तीन साल तक की कैद।
Imprisonment up to three years.
पोर्नोग्राफी (Pornography)-
अश्लील साहित्य के प्रयोजनों के लिए बच्चों का उपयोग, अश्लील साहित्य के भंडारण में बच्चों को शामिल करना। ये कुछ श्रेणियाँ हैं जो कि इस अधिनियम के अंतर्गत अपराध की श्रेणी में रखे गई हैं।
Use of children for the purposes of pornography, involving children in the storage of pornography. These are some of the categories that have been classified as crimes under this Act.
दंड का प्रावधान (Provision of Infliction)-
7 साल तक का कारावास और ₹1000000 तक का जुर्माना.
Imprisonment up to 7 years and fine up to ₹ 1000000.)
टिप्पणी (Note)-
पॉक्सो एक्ट में अपराधों के लिए उकसाना भी एक दंडनीय अपराध है। उकसाने से मतलब भड़काने, जानबूझकर सहायता करने, किसी और के साथ मिलकर अपराध की साजिश करने से न रोकना भी इस अपराध की श्रेणी में आता है।
Abetment to offenses under the Pocso Act is also a punishable offense. Provoking means to provoke, intentionally assist, not to stop conspiring with someone else in a crime also falls under this category.
दंड का प्रावधान (Provision of Infliction)-
6 माह से 2 वर्ष तक का कारावास।
Imprisonment from 6 months to 2 years.
